There are new requirements for landlords in British Columbia that we want to share with you to ensure everyone is prepared.
Key changes:
- Landlord Use Web Portal: From July 18, 2024, landlords must use the Landlord Use Web Portal to issue Notices to End Tenancy for personal, purchaser or caretaker use, with a unique notice ID for each termination. Access to this portal requires a Basic BCeID. The portal will provide landlords with crucial information about the conditions for ending a tenancy and the penalties for bad faith evictions.
- Eviction under the Residential Tenancy Act: Landlords can evict a tenant if the following individuals will be moving in:
- The landlord or a close family member (parent, spouse, or child)
- A purchaser of the property or their close family member
- A superintendent for the building
- Extended notice period: Effective July 18, 2024, landlords must provide tenants with four months' notice instead of two when evicting for personal or caretaker use. This change gives tenants more time to find a new home. Additionally, tenants will now have 30 days to dispute Notices to End Tenancy, compared to the current 15 days. The person moving into the home must occupy it for at least 12 months, and landlords evicting in bad faith may be ordered to pay the displaced tenant 12 months' rent.
We are committed to keeping an eye on any changes in the new policy to ensure we provide the best possible service to our clients.
